General Terms and Conditions of Sale (GTCS) 

1/ Purpose and scope of application

The present General Terms and Conditions of Sale (GTCS) establish the contractual conditions applicable to any sale concluded between Jellyfish SAS and its customers, whether they are individuals or retailers. The sales of products concern the products designed and marketed by Jellyfish SAS, namely bags, gloves, clips, and other accessories, specifically dedicated to the collection of litter. 

Any purchase implies full and complete acceptance of the current GTCS.

2/ Product prices

The prices of all our products are indicated in euros (€) all taxes included except participation in the expenses of treatment and shipping. 

The items will be invoiced on the basis of the prices in force at the time of order registration. They remain the property of JELLYFISH SAS until full payment is received. 

3/ Order and shipping

a) Ordering process 

The ordering process is as follows:


•Selecting items and adding to cart
•Validation of the contents of the cart
• Identification on the website 

• Choice of shipping method 

• Choice of payment method

• Validation of the payment and acceptance of the GTCS 

 

The Customer has the possibility of visualizing during the various stages the details of his order and its total price and to correct possible errors.
The Customer will receive an order confirmation e-mail following the validation of his order. 

JELLYFISH SAS remains the owner of the items until the order has been fully paid for, i.e. the price of the order has been received by JELLYFISH SAS. 

JELLYFISH SAS reserves the right to cancel or refuse any order from a Customer with whom there is a conflict relating to the payment of a previous order or who presents any form of risk in its eyes.

The validation of the order implies acceptance of the prices and description of the items available for sale. 

b) Shipping and Delivery

 

JELLYFISH SAS undertakes to deliver the items ordered and paid for to the address chosen by the Customer and according to the following delivery methods and times: 

 

Delivery in Metropolitan France:

The delivery is offered.

>The Customer must check the condition of the delivered items and notify JELLYFISH SAS of any anomaly within 30 days. By anomaly we mean: damage, missing item compared to the order form, damaged or opened package, broken item. 

For any delivery in a Chronopost Pickup Relay, the Customer must check the contents of the package as well as the condition of the items at the Relay point before signing any delivery slip (paper or electronic). Any parcel presenting an anomaly shall not be collected by the Customer without the responsibility of the state of the product being transferred to him. The Customer will inform (your site) of the problem encountered.

All items offered by JELLYFISH SAS are subject to the legal guarantee provided by articles 1641 and following of the Civil Code. 


 

4/ Payment

a) Payment methods 

Metropolitan France :
The Customer has the choice of his payment method among those:
- Credit/Debit Cards

- Bank transfer 

In case of payment by credit card, the Customer's bank account will be debited when the order is shipped. 


 

5/ Exchange, return and refund

a) Right of withdrawal 

Conditions:In accordance with the legal provisions in force, you have a period of 14 days from the receipt of your products to exercise your right of withdrawal without having to justify your reasons or pay any penalty. After communication of your decision to exercise your right of withdrawal within this period of 14 days, you have another period of 14 days to return the product or products concerned by the withdrawal.
JELLYFISH SAS will not be responsible for the cost of returning the goods.


 

b) Conditions of exchange and return for refund 

 

The returned item(s) must be in their original condition, perfectly intact and must not have been used, otherwise the Customer's responsibility will be engaged.

 

Any exchange or return must be requested by email at info@JELLYFISHHH.com.If the Customer's order includes several items and he wishes to return more than one item, he will have to select all the items he wishes to exchange or to be reimbursed during the return request. 
In France, the Customer should send the return by post to Jellyfish SAS at 6 bis rue chaudron 75010 Paris.
If the Customer returns items by any other means of transport, he/she will not be entitled to any refund from JELLYFISH SAS. 


 

c) Status of items 

All returned items must be sent back perfectly intact.

No returns will be accepted if the returned items have suffered a deterioration of their original condition making them unfit for sale or have been used.

If this is the case when the product(s) are exchanged, JELLYFISH SAS will be able to exercise all corresponding recovery actions against the Customer.

In the same way, if the returned product(s) were not in conformity, the refund could not take place.


 

d) Refunds 

 

In the event of a refund, the amount will be paid into the bank account specified in the claim.

In the event of receipt of a return package whose contents do not comply with the return request or whose items do not comply with the above-mentioned return conditions, JELLYFISH SAS reserves the right to take all corresponding recovery actions against the Customer. 

The Customer has 30 days from the date of receipt of the return package to make a claim.
No requests will be accepted after this period.The Customer will have to transmit his complaint to info@JELLYFISH.com. 


 

6/ Warranty 

Our items offered on JELLYFISH SAS are subject to the legal guarantee provided by articles L 217-4, and following of the Consumer Code and to the guarantee of hidden defects provided by articles 1641 and following of the Civil Code. 

The Customer has therefore two (2) years to make use of one or the other of these guarantees. For the lack of conformity, the period starts from the delivery. For hidden defects, the time limit starts from the discovery of the defect. 

In the case of an apparent defect, a lack of conformity or a hidden defect of the article an expertise will take place. This will be followed, if the defect is proven, by an exchange or a repair. In case of impossibility, JELLYFISH SAS reserves the right to reimburse the Customer at its own expense.

JELLYFISH SAS shall not be held responsible for the wrong use and/or abnormal use of the items by the Customer. Similarly, (your site) shall not be held responsible for the return of a competing product and/or one not sold on the Site by the Customer. It is up to the Customer to send back the good article. 

JELLYFISH SAS does not offer a commercial warranty.


 

7/ Responsibility 

JELLYFISH SAS is responsible for the proper execution of the contract concluded with the Customer.

However, in case of force majeure, we cannot be held responsible for the non-performance of the contract or for a defect in its execution.

We are not responsible for any hyperlinks that may be displayed on our site and create a prejudice for the Customer. 


 

8/ Reservation of ownership

JELLYFISH SAS remains the owner of the products until full payment is received.


 

9/ Intellectual Property 

All texts, comments, works, illustrations and images reproduced on JELLYFISH SAS are reserved under copyright law and intellectual property law for the whole world. Any total or partial reproduction of (your site) is strictly forbidden without an agreement to the contrary. 


 

10/ Applicable law 

The present general conditions of use and sale are subject to French law. In case of persistent disagreement on the application, interpretation and execution of the present terms and conditions, and in the absence of amicable agreement, any disagreement will be referred to the court of Paris, France.
